here's what democrats in sacramento did. they created a 1000-dollar appropriation, slapped it onto a bill that would put jerry brown's bill at the top of the ballot and passed it as a budget bill because budget bills go into effect immediately. of course when this happened the taxpayers association went to court and said absolutely, this is totally abusive, there's no way you can slap money onto the unrelated bill, say it's for a budget. and make it immediately. they said they're not going to stop the election from going ahead to the current system and on friday, third circuit appeals court ruled that what happened here was an abuse of process and should not happen again. >> what happens to the bill that puts constitutional amendments at the top of the ballot. >> it should be voided. they didn't say specifically but they did say it was entirely unconstitutional scenario and said that should actually make the law that ordered things on the ballot differently null and void. >> a lot of politics in the politics. is it retroacti
